Union Leader - Judge: NH wrong to deny gays benefits - Saturday, May. 6, 2006:
Concord – Requiring state employees to be married to receive family health and bereavement benefits, at the same time barring gays and lesbians from marrying, is discriminatory, a Merrimack County Superior Court judge ruled Wednesday.
Several attorneys believe the ruling could pave the way for all gay and lesbian state employees to receive the same family benefits as married employees.
Attorney General Kelly Ayotte's office said the decision by Judge Kathleen McGuire will be appealed to the state Supreme Court. "We are likely to ask for a stay" to block implementation of the decision, said Senior Assistant Attorney General Michael Brown.
